End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a church organization) and Apostello ("we," "us," or "our") for the use of the Apostello mission trip management and fundraising platform ("Service").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to these terms, you may not use the Service.

2. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your church's mission trip management and fundraising activities.

3. Subscription and Payment

  • The Service is provided on a subscription basis with annual billing
  • Subscription fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' notice
  • You are responsible for all taxes associated with your subscription

4. User Responsibilities

You agree to:

  • Provide accurate and complete information when registering
  • Maintain the security of your account credentials
  • Comply with all applicable laws and regulations
  • Use the Service only for lawful church mission trip purposes
  • Not attempt to reverse engineer, hack, or compromise the Service
  • Not use the Service to collect donations for fraudulent purposes

5. Data Ownership and Privacy

  • You retain ownership of all data you input into the Service
  • We will not sell or share your data with third parties except as outlined in our Privacy Policy
  • You are responsible for complying with data protection laws regarding participant information
  • We implement industry-standard security measures to protect your data

6. Payment Processing

  • Donation processing is handled through Stripe Connect
  • Donations go directly to your church's connected bank account
  • Standard Stripe processing fees (2.9% + $0.30 per transaction) apply
  • We are not responsible for Stripe's processing, delays, or disputes
  • You must comply with Stripe's Terms of Service

7. Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR LOST DATA, DONATIONS, OR BUSINESS INTERRUPTION

9. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or emergency fixes that temporarily limit availability.

10. Termination

  • You may cancel your subscription at any time
  • We may suspend or terminate your account for violations of this Agreement
  • Upon termination, you will have 30 days to export your data
  • We reserve the right to delete your data after the 30-day period

11. Modifications to Service and Agreement

We reserve the right to modify the Service or this Agreement at any time. Material changes will be communicated via email with 30 days' notice. Continued use after changes constitutes acceptance.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of this Agreement, or infringement of any third-party rights.

13. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions.

14. Governing Law

4. Data Security

5. Data Retention

  • We retain data for as long as your account is active

In the event of a data breach that affects your personal information, we will notify you and relevant authorities within 72 hours as required by law.
